However, I will need to open a limited company to become a freelancer in Portugal. They, however, have an office in the UK. Therefore, it is likely that I will be an employee from the UK, as it might be easier than from Aus. If you're thinking about register as a self employed you don't need to worry about the name or register the business, you only need to get a Portugueses fiscal number for yourself and start the activity in the finances. After you have your activity registered in the finances you need to contact the local authorities in order to start the process to obtain all necessary licences.

In order to start your business you don't need any specific qualification, you only need to know how to do what you will register your company. You don't need 5.000 €, you can have a smaller social capital, but no less then 1.000 € (my opinion) Regarding the decision between a sole trader or a company that will depend on your estimate cost from the activity. Regarding the situation of bring your familly that matter I can't help you because it is out of my range of knowledge.

That is not a garantee to get the residency permit but it is a start. The diference is that sometimes acourding to the kind of business and the volume of sales is better to register a company then a self employed, as well as the responsability that in a company is limited and as a self employed is unlimited. After that you will determined if your services will be superior to 10.000 € or not in order to become you subject or not to VAT. This is a 2 step situation, first get the portuguese fiscal number and then register the company. You will only need your passaport and proof of your adress in the country you live like a water built or something like that. Then you must find a place, and usually the places already have licences to develope some activities. You can employ people either as a self-employed either as a company. The only thing is that if you are a self-employed and employed someone from your family the cost is not acepted and if you are a company that cost will be totaly acepted. Also in terms of social security if you are a company the value will be calculated over your salary if you are a self employed it will be calculated over your sales from the previous year, on the fisrst year you will be isempt if you are a self-employed. The register of the company will cost you 360 €, the register as a self-employed is free of charge. The tax over the profit of the companies is 21 %, in terms of self-employed the tax will be over the income you will have as a person trought the year and it goes from 14% until 48%

He must come to Portugal with a business visa issued in his country, then he can open a company and aply for a residency visa in Portugal, but with no guarantees that he will get one.

Hi Claudia, I am currently self employed as a virtual assistant in the UK and am planning to move to Portugal early next year. I hope to move the business with me and to continue to work remotely for customers in the UK. I have been advised by HMRC that I am not able to stay registered as self employed here. I am currently trying to contact them to find out about setting up as a limited company here and working (as the only director and employee) in Portugal, I will continue to try to speak to them. I just wanted to check what I believe to be the main barrier to me setting up in business in Portugal. I believe that if I were self employed in Portugal I would be liable to pay social security contributions of €130 per month (€1560 per year). As I only run my business part-time and am still getting established, my turnover this year will be less than £4000 (approx. €5000). In this case, the social security costs would be approx. 30% of my total turnover, which has led me to conclude that it is not viable to register the business in Portugal. If this is correct, and I am unable to register as a limited company in the UK, I feel that I would have no other choice than to wind up the business. This is disappointing as I want to work, I am just getting established, and my customers have just begun to trust me and rely on my work. Regarding the transport of tools that allows you to do your work, you don't have to have a transport guide, because that belongs to your activity, I think you are a self-employed here in Portugal correct? Regarding the product that you're going to sell, like horseshoes, you should have a transport guide, when you carry those products to the clients. You should ask for your accountant help, if you don't have an accountant, you must see how you pass the invoice, if it is manual or through certified software and proceed the same way regarding the transport guides. Regarding the second question, if the products you sell are in Holland and come to Portugal, you should charge the VAT from Holland, or apply the rules of exemption if it is a sale to a VAT subject in Portugal.

Thank you for your contact. In order to have a business you must either open an activity as a self-employed or open a company. I believe to start, you can register as a self-employed with organized accountancy, in order to consider all your investment as a cost. The costs of this are the cost of social security, minimum 150 € every month, and an accountant, and the value will depend on the work. The accountant will open your activity, and then you must have a shop and buy the material of course. To open a company in Portugal, you will need to make the register in Empresa na Hora. The managers of the company need to get a Portuguese fiscal number. You can make this from the UK, but only if you have a person here in Portugal with a power of attorney, with powers to make the company, that is a litle more complex, so I advise you to come and make it. The process only takes 2 days, one to get the Portuguese Fiscal number and the other to register the company. The cost of the register is 360 €, and the fiscal number is 11,00 €. Regarding the residency visa, we have no information about the time of approval, but never less than 3 months. The application to residency visa is made by attorneys. CEF, will then analyze your application and decide to give you or not the residency Visa.

Cláudia AzevedoDear Claudia I purchased an apartment in Portugal in May 2010 which I rent to tourists as holiday accommodation. The property was constructed in 2007 and the developer rented out the property to tourists before selling it on to me. My purchase contract simply discloses the price I paid, without any mention of VAT. Given that I purchased the property as a business venture (i.e. to rent to tourists), I have questioned the VAT-status of this transaction. The vendor has stated that "in Portugal, VAT is not due on the purchase of real estate properties and therefore there was no VAT included in the purchase price of your property". However, in the UK, holiday accommodation does attract VAT when purchased, provided that it is less than 3 years old. Does the same VAT rule apply in Portugal? Assuming that the VAT rules are consistent and given that the property was being purchased for business purposes, should the vendor have charged VAT, or can I assume now that the purchase price did actually include Portuguese VAT? Cláudia AzevedoDear Claudia, In 2007 I was advised by a lawyer in Oporto to set up a company since it was my intention to buy and renovate ruins. We set up an SA and I bought 2 ruins. Unfortunately, with the economic crisis in 2008 my resources were affected plus the architect appointed has taken 3 years to obtain planning. (He was not a real architect, I later discovered.) I have had all sorts of problems with my representatives in Oporto (one of them, the procurador) who is my cousin. I am in the process of selling one of the properties but my cousin failed to register the land and I am now having to pay a lawyer in Serta to correct this error. Fortunately the buyers understand are still continuing with the purchase. Building has started on the second property in Dornes. Essentially, I would like to move the Company HQ, change accountant and remove my cousin from his role as procurador of the company. I have sought advice about closing down the company but am told that I cannot do this now that I have commenced construction in Dornes. I am told I have to wait until I have sold the property before I can close down the company. Do you know anyone who I could trust to look after my affairs in Portugal and what is your advice? Dear Claudia I have a number of holiday properties on the silver coast. What tax advantages are their in leaving the profits in portugal to re-invest in further projects. Bar the running expenseds I have so far been drawing the profits out in the UK. Am I being charged double tax? Can you advise a more efficient process. So if you leave your profits here it will be as a person not as a legal firm or self employed, correct? In the UK you declare your income from Portugal, but here in Portugal you don't declare anything, correct? How is your taxes aply to your income in the UK?
