  1. Hello. Im planing to start a business in Portugal. Im looking in to having a fleet of food trucks in the central region of Portugal with connection to the surf industry. Were do i turn to get information on licensing and all that is needed for me in order to take the first step. I need information on what is needed to get its started, so first of all the starting of a LDA, then what authorities that i need to get licences and or inspections from in order to run a restaurant business. The procedure of creating a new company in Portugal is initiated and concluded on the same day, on an unique place (conservatory), unless you need to get first a Portuguese fiscal number and in that case it will take two days. You can decide if the society is built with 1 partner or two or more partners. One must be nominated the manager
    The register costs for opening a new company are 360,00 €.

  3. Hi Claudia, i was looking to start up on the Rio. The sport is Zorbing on Water. We have the Rio running through our property but wondered what the legalities are for this & wondered if it would be possible to do it in the local town & other areas? You can choose between a tax of 28% over rent profits or if you deliver your tax income in Portugal you can put it together with your income, and be taxed according to the total amount of income. If you deliver your annual tax declaration in the UK you must declare this income as obtain abroad and prepare to pay more or less between 25% to 28% of the amount.
    The expenses are works in the apartment, the tax you pay over the property (IMI), and nothing else.

  8. Hi Claudia, I have built and operated 2 small hotels in the Algarve for the last 10 years and now it is the time to retire and sell the business. The turnover is around E1m and the next profit is around E330,000.The company owns the freeholds to the properties and there are no borrowings. I understand that in Portugal i need to have a list of everything that is in my work car (tools, horseshoes etc.) is this true? Where can i find an example of the kind of paperwork i need to use for this?     Thank you for your question. Regarding the transport of tools that allows you to do your work, you don't have to have a transport guide, because that belongs to your activity, I think you are a self-employed here in Portugal correct? Regarding the product that you're going to sell, like horseshoes, you should have a transport guide, when you carry those products to the clients. You should ask for your accountant help, if you don't have an accountant, you must see how you pass the invoice, if it is manual or through certified software and proceed the same way regarding the transport guides. Regarding the second question, if the products you sell are in Holland and come to Portugal, you should charge the VAT from Holland, or apply the rules of exemption if it is a sale to a VAT subject in Portugal.

Regarding the legalities, if you're going to trade from the UK, I believe the only connection with Portugal will be the purchase, so if you're register in the UK that won't be a problem.

What is the amount needed, the hotel exists or not, and after that make a project, where you identify all the costs and revenue. Only with that study can you ask for a loan. Since your area is tourism we can even see if there are loans specific to that, usually with better rate. Yes it is possible to have your own business in Portugal, and with a company establish you can ask for residency visa, you also have to make your discounts in Portugal and have a house (rented or not). In order to have the company you need to come to Portugal with a tourism visa and get a Portuguese fiscal number. After that you can make the company.   21. Hello Claudia. I am a UK citizen who is currently working in the Algarve in Portugal. I am interested in starting a mobile juice bar business here. I am based in the surfers area of the algarve near the beaches of carrapateira, amoreira and arrifana (a national park) 40km from Lagos. I was wondering where I start in regards to registering myself as self-employed and having the correct licenses as a foods and beverages vendor. Also I am aware that this area is a national park and so the beaches are protected and this may be "red taped", however there are other businesses flourishing in this area and there is a real gap in the market for this kind of enterprise. We would be promoting a healthy, environmentally aware enterprise with recyclable packaging and a message of preservation of this beautiful area, but who would we contact in regards to legally be allowed to park in a close proximity to these beaches?     Thank you for your contact. In order to have a business you must either open an activity as a self-employed or open a company. I believe to start, you can register as a self-employed with organized accountancy, in order to consider all your investment as a cost. The costs of this are the cost of social security, minimum 150 € every month, and an accountant, and the value will depend on the work. The accountant will open your activity, and then you must have a shop and buy the material of course. The financing opportunities are quite low, but still possible in some sectors, and tourism is one of them.     First of all it is very important for you to have an idea of the place you want to establish your business, because the prices will depend on it. If you want to open a small coffee shop my advice is to open your activity as a self-employed with organized accountancy, the costs are less.
    If you choose Lisbon, you have in terms of tourism, Baixa Lisboeta, Belém, Cascais, these are more expensive areas, but with a lot of tourism. Sintra is very nice too, but as I told you the prices will depend of the area of the place and the localization.

    To open a company in Portugal, you will need to make the register in Empresa na Hora. The managers of the company need to get a Portuguese fiscal number. You can make this from the UK, but only if you have a person here in Portugal with a power of attorney, with powers to make the company, that is a litle more complex, so I advise you to come and make it. The process only takes 2 days, one to get the Portuguese Fiscal number and the other to register the company. The cost of the register is 360 €, and the fiscal number is 11,00 €.     Thank you for your question. The expenses regarding a business are variable according to the business. If you need to have a warehouse the cost of it depends on where and how big it will be. The register of a company costs 360 € and to get you a Portuguese fiscal number cost 11,00 €.
    Regarding the residency visa, we have no information about the time of approval, but never less than 3 months. The application to residency visa is made by attorneys. CEF, will then analyze your application and decide to give you or not the residency Visa.

  79. Dear Claudia I purchased an apartment in Portugal in May 2010 which I rent to tourists as holiday accommodation. The property was constructed in 2007 and the developer rented out the property to tourists before selling it on to me. My purchase contract simply discloses the price I paid, without any mention of VAT. Given that I purchased the property as a business venture (i.e. to rent to tourists), I have questioned the VAT-status of this transaction. The vendor has stated that "in Portugal, VAT is not due on the purchase of real estate properties and therefore there was no VAT included in the purchase price of your property". However, in the UK, holiday accommodation does attract VAT when purchased, provided that it is less than 3 years old. Does the same VAT rule apply in Portugal? Assuming that the VAT rules are consistent and given that the property was being purchased for business purposes, should the vendor have charged VAT, or can I assume now that the purchase price did actually include Portuguese VAT?   81. Dear Claudia, In 2007 I was advised by a lawyer in Oporto to set up a company since it was my intention to buy and renovate ruins. We set up an SA and I bought 2 ruins. Unfortunately, with the economic crisis in 2008 my resources were affected plus the architect appointed has taken 3 years to obtain planning. (He was not a real architect, I later discovered.) I have had all sorts of problems with my representatives in Oporto (one of them, the procurador) who is my cousin. I am in the process of selling one of the properties but my cousin failed to register the land and I am now having to pay a lawyer in Serta to correct this error. Fortunately the buyers understand are still continuing with the purchase. Building has started on the second property in Dornes. Essentially, I would like to move the Company HQ, change accountant and remove my cousin from his role as procurador of the company. I have sought advice about closing down the company but am told that I cannot do this now that I have commenced construction in Dornes. I am told I have to wait until I have sold the property before I can close down the company. Do you know anyone who I could trust to look after my affairs in Portugal and what is your advice?
